Sellerviva Terms of Service
Version 2.1 — effective 7 October 2026. These Terms govern your access to and use of Sellerviva. By creating an account, you agree to these Terms. Version 2.1 replaces version 2.0 published on this page; it updates the description of the service, which now includes selling your own Amazon inventory on eBay. The rest of the Terms is unchanged.
Provider
"Sellerviva" is the brand under which the service is offered. The party to these Terms, the operator of the service and the issuer of invoices is Bays Trade LLC, a limited liability company established in the United States. Legal notices: [email protected] · Privacy: [email protected] · Support: [email protected].
Nature of the service
Sellerviva is a business-to-business software service for online sellers (Amazon-to-eBay selling automation: product import, listing drafts, pricing and stock synchronisation, order fulfilment and return tracking, including selling your own Amazon inventory on eBay). You must be at least 18 years old and must use the service for business purposes; if you act for a company, you confirm that you are authorised to bind it.
Accounts
You are responsible for keeping your account credentials secure and for all activity under your account. Enable two-factor authentication where available and notify [email protected] immediately of any unauthorised use.
Account security and recovery
If Sellerviva reasonably suspects that the security of an account or of a connected store has been compromised, it may terminate sessions, revoke security keys or connections, temporarily stop particular operations, or temporarily freeze the account. During account recovery Sellerviva may apply additional verification, independent proof of ownership, human review and a security waiting period. If the evidence is insufficient or if there is an objection, the account may remain frozen until the risk has been resolved. Our support team will never ask you for your password, a one-time verification code, a two-factor backup code or a full access key by email, chat or telephone.
Liability for temporary security measures. Sellerviva uses reasonable efforts to limit the interruption of service caused by temporary restrictions that it applies in good faith and in accordance with reasonable security procedures in order to protect the account and the persons concerned. To the fullest extent permitted by applicable law, Sellerviva is not liable for indirect losses arising from such temporary security measures. This provision does not apply to Sellerviva's gross negligence, wilful misconduct, data protection obligations, or liabilities that cannot be limited by law.
Subscriptions and billing
Paid plans start after a 7-day free trial. Subscriptions renew automatically until cancelled. Fees are based on your selected plan. You may cancel at any time from within the application; cancellation takes effect at the end of the current paid period and no charge is made for the next period. If you cancel during the trial, your card is not charged.
Acceptable use
You agree to use Sellerviva in compliance with the policies of the marketplaces and suppliers you connect, and with applicable law. You remain responsible for the accuracy and the legal and platform-policy compliance of every listing you publish, every message you send and every commercial decision you make through the service.
AI features
Some features of the service (for example listing text drafts and suggested replies to buyer messages) are provided by an artificial intelligence system based on large language models supplied by a third-party model provider named in the Privacy Policy. You are informed of this before first use and within the application wherever such a feature is offered.
AI features produce drafts only. Outputs are presented to you as AI-generated drafts and are not published or sent without your review; the final content decision is always yours. No guarantee is given that AI outputs are accurate, complete, current, original or fit for a particular purpose. Where the model provider marks its outputs in a machine-readable way, we do not remove such marking; we do not insert hidden marks into listings or messages you choose to publish. As the party publishing listings or sending messages you remain responsible under the law applicable to you, including any disclosure obligations concerning AI-generated content in your jurisdiction. The service does not perform emotion recognition or biometric categorisation and does not generate "deep fake" image, audio or video content. This section reflects the transparency obligations of Regulation (EU) 2024/1689 (the "AI Act") Article 50 and creates no obligation broader than the law requires.
Data export and account deletion
The service provides a feature to download your data in machine-readable form. You may request deletion of your account from within the application; 7 days after the request your account is anonymised, your personal data is deleted or de-identified and your sessions are invalidated. You may withdraw the request within the 7-day waiting period. Records that must be retained for tax, accounting, audit and legal-defence purposes (invoice and payment records, evidence of contract acceptance, related audit trails) are kept for the period required by law, solely for that purpose and with restricted access.
Data portability and switching (EU Data Act)
Regulation (EU) 2023/2854 (the "Data Act") applies to data processing services, including software-as-a-service, offered to customers in the European Union, regardless of where the provider is established. Where you are such a customer, this section applies in addition to the sections above and prevails over them in case of conflict.
- Right to switch. You may at any time terminate the service in order to switch to another provider or to your own infrastructure, or simply to stop using the service. The maximum notice period for initiating switching is two months; you may give shorter notice. No subscription period that begins after the switching date is charged.
- Transition period. After your switching request we complete switching within 30 days. Only where that is technically unfeasible do we notify you within 14 working days and extend the period, which then does not exceed seven months. During the transition period the service remains available to you under these Terms at a level not below the one you enjoyed before.
- Exportable data. Throughout your use and during the transition period you may retrieve, via the in-app download feature and the public API, all of your exportable data (the data you imported into or generated in the service, such as products, listings, orders and settings, that is not a trade secret or proprietary asset of Sellerviva) in a structured, commonly used and machine-readable format (JSON/CSV). We impose no pre-commercial, commercial, technical, contractual or organisational obstacles to your switching.
- Charges. We charge no switching or data egress fees.
- Retrieval period. After switching is completed, your exportable data remains retrievable for at least 30 days; thereafter, and in any event upon your request, it is erased as described above, save for records subject to statutory retention.
- Information. Available export methods and formats and any known interoperability limitations are described in the Help Center and the public API documentation; on request we provide this information in writing.
Service availability
We work to keep Sellerviva reliable but do not guarantee uninterrupted availability. Features may change as the product evolves.
Limitation of liability
Sellerviva is provided "as is." To the extent permitted by law, we are not liable for indirect or consequential damages arising from use of the service, including errors in AI outputs.
Regional provisions
- EU/EEA and United Kingdom. Nothing in these Terms limits rights that cannot be limited under the mandatory law of your place of establishment. For personal data the GDPR and the UK GDPR apply as described in the Privacy Policy. Should you qualify as a consumer under applicable law, mandatory consumer-protection provisions prevail.
- United States. The service is offered to businesses. To the extent a US state comprehensive privacy law applies to personal data of your representatives, the rights and our commitments are described in the Privacy Policy. We do not sell personal data and do not share it for cross-context behavioural advertising.
- Türkiye. Personal data of users in Türkiye is processed under Law No. 6698 (KVKK) as amended; the KVKK Article 10 notice is part of the Privacy Policy. Commercial electronic messages are sent only with your prior opt-in consent under Law No. 6563 and the Regulation on Commercial Communication; the merchant/tradesman exception is not relied upon.
Changes to these Terms
We may update these Terms from time to time. Each change is published as a new version with its effective date; prior versions remain available on request. For material changes we give notice in the application and/or by email a reasonable time before the effective date. You may accept the new version expressly in the application; where you do not, continued use of the service on or after the effective date constitutes acceptance of the new version. If you do not wish to accept it, you may stop using the service, cancel your subscription and close your account. A change notice never blocks your ability to cancel, download your data, delete your account, obtain support or sign out.
